These Terms govern use of the Cutie P.A.W.S. website and participation in website-based donations, applications, and services. By using the website, you agree to these Terms and incorporated policies.
1. About Cutie P.A.W.S.
Cutie P.A.W.S. — Proactive Animal Welfare Support — is a nonprofit organization based in Carson City, Nevada. We are developing proactive animal-welfare infrastructure through TNRh, rescue and rehabilitation, foster-based care and adoption, emergency boarding and pet-retention support, rural outreach, and Sagebrush Sanctuary & Lifelong Care.
2. Website Use
You may use this website only for lawful purposes. You may not attempt unauthorized access, disrupt operation, introduce malicious code, impersonate another person, submit knowingly false information, harvest information, or use the website to threaten, harass, exploit, or harm any person or animal. We may restrict access when reasonably necessary.
3. Information and Availability
We work to keep website information useful and current, but do not promise that all content is complete, error-free, continuously available, or suitable for every circumstance. Programs, service areas, eligibility, adoption listings, fees, policies, and facility timelines may change. Website content is general information and is not legal, medical, veterinary, financial, or tax advice.
4. Intellectual Property
Unless otherwise identified, website text, logos, graphics, photographs, illustrations, and design are owned by or licensed to Cutie P.A.W.S. You may view and share links for personal, noncommercial purposes. Reproduction, modification, distribution, commercial use, or removal of ownership notices requires prior written permission or another lawful basis.
5. Submissions
You confirm that information you submit is accurate to the best of your knowledge and that you have the right to provide it. Submission of an application does not guarantee acceptance, placement, service, or approval. Personal information is handled under our Privacy Policy. Media use is governed by a separate Photo & Media Release when applicable.
6. Third-Party Services
The website may link to payment processors, donor-advised fund portals, wish lists, application tools, and other third-party services. We do not control and are not responsible for their content, security, availability, or practices. Your use of them is also subject to their terms.
7. Donations
General gifts
Donations are voluntary and generally final. Refund requests are handled under our Donation Refund Policy.
Restricted gifts
We will make reasonable efforts to honor an accepted written restriction. If the identified purpose becomes impossible, impracticable, fully funded, or inconsistent with legal or operational requirements, we will handle the gift in accordance with donor communications, governing documents, and applicable law. We will not silently convert a legally restricted gift into unrestricted support.
Donor-advised funds
DAF sponsoring organizations retain legal control of grant funds. Donors may not receive goods, services, or more than incidental benefits in exchange for a DAF grant. DAF grants should not be used for adoption fees, event tickets, raffles, auctions, or other purchases or benefits with personal value.
Tax and planned-gift information
Cutie P.A.W.S. does not provide individualized legal, financial, or tax advice. Donors considering trusts, estates, securities, or other planned gifts should consult qualified advisers.
8. Adoption
Application submission does not guarantee approval. Adoption decisions are made under then-current animal-welfare policies and the individual animal’s needs. Fees, return requirements, medical disclosures, housing standards, veterinary care duties, and any right to reclaim an animal are governed by the signed adoption agreement. If these Terms conflict with a signed agreement, the signed agreement controls for that placement.
9. Foster, Volunteer, and Program Participation
Participation may require screening, training, waivers, confidentiality commitments, safety rules, or a separate agreement. Participants must provide truthful information, follow written protocols, maintain safe environments, and promptly report concerns. We may deny, pause, or end participation for safety, capacity, compliance, or animal-welfare reasons.
10. Emergency Boarding
Emergency boarding is temporary care and does not transfer ownership unless a separate written surrender or other legally effective process occurs. Duration, contact requirements, fees, veterinary authorization, retrieval, extensions, and consequences of abandonment or nonresponse are governed by the signed boarding agreement and applicable law. Nothing on this website alone authorizes Cutie P.A.W.S. to take ownership of an animal.
11. Health, Behavior, and Program Risk
Work with animals involves inherent risks, including bites, scratches, allergies, zoonotic illness, escape, property damage, and unpredictable behavior. Known information is shared when reasonably available, but an animal’s history, health, or future behavior cannot be guaranteed. Program-specific agreements and waivers may contain additional terms.
12. Disclaimer of Warranties
To the fullest extent permitted by law, the website is provided “as is” and “as available,” without express or implied warranties. This does not waive rights or obligations that cannot legally be waived.
13. Limitation of Liability
To the fullest extent permitted by law, Cutie P.A.W.S. and its directors, officers, employees, and volunteers will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from website use. Any program-specific liability is governed by applicable law and signed agreements. Nothing in these Terms excludes liability that cannot legally be limited.
14. Indemnification
To the extent permitted by law, you agree to defend and indemnify Cutie P.A.W.S. from third-party claims arising from your unlawful website use, intentional misconduct, violation of these Terms, or infringement of another person’s rights. This provision does not apply where prohibited by law.
15. Governing Law
These Terms are governed by Nevada law, without regard to conflict-of-law principles. Subject to any mandatory law or written agreement providing otherwise, disputes concerning the website will be brought in a court of competent jurisdiction in Carson City, Nevada.
16. Changes; Severability; Entire Agreement
We may update these Terms by posting a revised version and date. Continued website use after an update means the revised Terms apply prospectively. If a provision is found unenforceable, the remaining provisions remain in effect. These Terms, incorporated policies, and any applicable signed program agreement form the agreement governing the relevant activity; a signed agreement controls if it expressly conflicts.
